Welcome to Rock The Valley! These Terms of Service govern your access to and participation in the festival. By purchasing a ticket or attending the festival, you agree to comply with these terms. Please read them carefully.
Acceptance of Terms: By purchasing a ticket from See Tickets, entering the festival grounds, or participating in festival activities, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree, please do not purchase a ticket or attend the festival. You also awkowledge SeeTickets terms and conditions, and agree that all sales are final and non-refundable for any reason.
Ticket Purchase and Admission: Sales Policy: All ticket sales are final. No refunds or exchanges will be offered for any reason, unless otherwise noted. In such cases, refunds will be processed within reasonable time of the cancellation announcement. Ticket Transfer: Tickets are non-transferable. Unauthorized resale or duplication of tickets is strictly prohibited and may result in ejection from the festival without refund. Entry Requirements: Attendees must present a valid ticket for verification at the entrance. Failure to do so will result in denial of entry.
Health and Safety Regulations COVID-19 and Health Guidelines: Attendees must adhere to any public health guidelines, including mask-wearing or vaccination requirements, as mandated by local authorities or festival organizers. Prohibited Items: For safety reasons, the following items are not permitted on festival grounds: Weapons (including but not limited to firearms, knives, or any items that could be used as a weapon) Illegal substances or drugs Professional recording equipment (without prior approval) Outside food or beverages (exceptions for dietary needs) Medical Emergencies: In the event of a medical emergency, please notify festival staff immediately. Medical assistance will be available on-site.
Photography, Recording, and Media Consent to Use Image: By attending the festival, you grant Rock The Valley the right to capture and use your image and likeness in photographs and videos for promotional and commercial purposes without compensation. Media Access: Only credentialed media representatives may use professional recording devices. All other attendees may take photos and videos for personal use only.
Liability Waiver and Release Assumption of Risk: Attendance at Rock The Valley involves inherent risks, including but not limited to injury, loss, or damage to personal property. By attending, you assume all risks associated with participation. Release of Liability: You agree to release and hold harmless Rock The Valley, its affiliates, sponsors, and employees from any claims, liabilities, damages, or expenses arising from your attendance or participation in the festival.
Code of Conduct Respectful Behavior: All attendees are expected to behave in a respectful and considerate manner. Harassment, discrimination, or any form of disruptive behavior will not be tolerated.
Enforcement: Festival staff reserve the right to eject any attendee who fails to comply with the code of conduct without refund.
Changes to the Festival Lineup Changes: Rock The Valley reserves the right to change the lineup, schedule, or venue at any time due to unforeseen circumstances. We will make reasonable efforts to notify attendees of significant changes via email or social media. Weather Policies: The festival will proceed rain or shine. In the event of severe weather, Rock The Valley will communicate any safety measures or cancellations through official channels.
Governing Law and Dispute Resolution Jurisdiction: These terms shall be governed by the laws of [West Virginia]. Any disputes arising under these terms will be resolved in the appropriate courts located in [Monongalia County]. Dispute Resolution: In the event of a dispute, you agree to first attempt to resolve the issue informally by contacting disputes@rockthevalleyfest.com. If the issue cannot be resolved, you may seek resolution through arbitration as outlined below.
Arbitration Agreement Binding Arbitration: Any disputes, controversies, or claims arising out of or relating to these Terms of Service shall be settled by binding arbitration in accordance with the rules of the West Virginia Code of Conduct and will take place in Monongalia County, WV. No Class Actions: You agree that any arbitration will be conducted on an individual basis, and not as a class action or class arbitration.
